I can see sammyb's frustration but there is something to be said for collective intelligence and opnion. If we start restricting access to the site we loose out on the "Wisdom of the Crowds". A good example is free file sharing websites that have very few people contributing (<10%) but the benefit to the community is huge and the membership becomes ever larger because it is free. So as IV becomes more popular (which should be are foremost goal) there will be more people willing to contribute (even though the percentage of people contributing might still be small). I am not making a case for free loaders, instead I am making a case for free access to information.
I salute Needhelp! for her commitment to this cause.
Why can't we move from a free service to a membership based and see how many people still continue ... evenif with 25K members it is only a handful who are active and part of the initiative ... so I would suggest to go for a membership ...
it could be a per month basis or pay a big amount and get membership for life or year ... say $200 for a year or $20 for a month ... we don't need the number/mass unless they are active in all way ... just my thoughts ... hope the IV core team will consider that ... enough of free rides ... now pay for it and get the access to forums ... :mad:

There is nothing really called transfer. When you are filing for the first time its counted against the cap. Otherwise its not. So when you are transfering the H1

It is contradicting because you are applying Louisiana Senate Law's and Robert's Rule which is a guide to conduct a board meeting to United States Senate. All three are three different things !!!! If you are from India or from a country which fought for its freedom, you would not ask this question.
When M.K.Gandhi held his first rally against the British rulers(nothing personal here Franklin and Mark :) ), it did not result in immediate freedom, but was it worthless ?
It's not just India that won freedom either, don't forget USA!
Although I do admire Gandhi's approach more.

People probably don't have the faintest idea under what kind of financial strain these are. There will be exemptions for universities and non-profit organizations.

this whole issue of undistributed visas has been going on since 2005. It was thoroughly digested/analyzed by many, many people. The discussions had a lot of infighting just like this thread does.
The law hasn't changed; therefore, a different interpretation leaves open possibility of lawsuits.
I read the law to say specifically that if there is more people in que for greencard then hard limit of 7% to anyone country. Until there is less demand for eb1/eb2/eb3 as a whole then hard cap.
2005 and 2006 the number of greencards issued to anyone particular company had 7% total. Last year; particularly the summer, visas were used to overflow to china/india when they shouldn't have because in september eb3 row was retrogressed and so was eb2 row. Under the law; if eb3 row is not current then there can be no overflow of visas.
Most of row has sat idly while the visas have overflowed when they should not have. All it takes is someone from ROW to sue USCIS over this. However; no one does simply because by the time the lawsuit comes; there dates would probably be current and lawsuit would go away.
as an fyi; i don't think anyone has posted but there has been some peoples greencards which were approved in september and october where uscis sent a notice to rescind because the date wasn't current when it got approved. USCIS does have a track record now of rescinding or starting recission procedures if they have made a mistake. Its a funny idea that we can help them write a pgm. But be real, It is a gov data and will have sensitive info. It takes money to make money. So lets spend it.. 5K is not a big deal. It is perfectly legal to ask for money when we need info from FOIA.

Apart from Deniel notice I also got LUD on I 140.
Could it be related to old employer revoking I 140?
Since I have transfered after 180 and did Ac 21 - am I covered.
Prince - Did you get any LUD on 140 on the day you got this deniel e mail?

Hi Gurus,
Right now I am working for Company A and VISA with company A is valid till September 30 2007. Company B applied for Regular H1-B transfer (Receipt Date May 12) and it is still under process. I will be joining Company B on 1st October 2007.
Now due to some emergency I am traveling to India on 11August, 2007 and will come back on 11 Th September 2007. Also I can�t go for VISA stamping in India for Company B as I have not got my H1 Approval yet.
Given the above scenario, will I have any problem at the port of entry as my H1b transfer from company B has not been approved yet?
What all documents I have to carry to reenter safely?

Good luck with the MTR, I hope your attorneys are able to file it ASAP, and your 485 gets reopened even faster.
I switched employers about a year or so after my 485 had been filed (140 approved) and my employer has informed me that they are going to have to revoke my 140 soon.
The attorneys at the new employer's filed AC21, G28, etc., but looking at everyone's experience, I too am expecting to get a denial or at best, a NOID/RFE once the 140 is revoked.
I don't have answers to your questions unfortunately, but I would think that even if the 140 was used for someone else, you shouldn't need a new one, since you switched employers after 180 days of 140 approval, and for those 180 days the 140 was not revoked/reused. Of course, an attorney has to confirm this.
Please do keep us posted on how things go, how long the MTR takes, etc.
In the meantime, do you have to go on unpaid leave, because of your EAD becoming invalid or do you have backup status such as the H-1B?

Which embassy? I had the same experience when I renewed my passport. For passport renewal we need to apply on line. When they gave me the new passport, it had the wrong issuedate of the original passport. When I asked about that the lady in the counter started yelling at me saying its my fault and it is what I typed on line. She showed me her computer screen as if its my fault and finally they made a note in the passport with pen.
After I came home, I checked the copy I took when I applied and I entered correct information. Interesting thing is same typos happened to several people on the same day, and the embassey staff told every one the same story.

If u travel while H1 is pending then its deemed abandoned. U have to file for ur H1 again thru company B and start over the process. Rather I suggest you to convert it into premium and get the approval before you leave.
