Hi
I got laid-off in Jan'09 and was not able to get a job. I returned back to India on 01-May-2009. I would like to come back to US since the economy is coming-up. Below is my situation:
Filed I-485 and it is in Pending status (Priority Date is May-2007). I-140 approved in Jan 2008.
Renewed EAD which is valid till July 2010. But AP got expired by 15-July-2009.
6 years of H1B expired by 31-May-2009.
1. What are my options now to come back to US?
2. When can I file for my new H1B? I heard there should be 1 year gap between H1B.
3. Will I be considered in regular quota OR I will get H1B on previously held quota?
Your suggestion will greatly help. Appreciate it.

1. I am on 6th year of H1 this year and my H1 expires on 30 Sept 2010. I have to apply for H1 extn this year.
2. My employer started GC process (EB3) in 2006 on substitute labor of Aug 2005. He applied I 140 in April 2007.
3. He applied EAD when they are current during June, July 2007 based on substitute labor. I and my wife got EAD eventhough my I 140 is pending.
4. As old I 140 is pending he applied another I 140 with different EB3 labor for me in 2008 and both new labor and I 140 got apporved. He ported my A# of EAD card to this new I 140 showing as beneficiay on it.
5. My old I 140 is still pending and USCIS didnt send any query on that till date. My employer is confident on getting approval of old I 140.
Here are the questions I have:
Can I work on EAD by taking full time jobs by applying AC 21? Does it safe to work on EAD?
If my old I 140 gets any problem what are consequences with my GC process?
Can anybody answer, Please.

Hi All,
I just gave my fingerprints today. I got a match warning for almost all my fingers. I dont remember giving all my finger prints to USCIS at any point of time.. At the max, I would have given thumb and index finger when i travelled.. does this mean i am in trouble?

If you have a pending permanent residency application you should still be able to work under h1b status, particularly if your i-140 is approved.

Recently i have joined a new employer after my H1 transfer has been applied, today i have recieved approval notice and its approved until October 15 2007,
were has my previous h1 was valid until October 2008. Please help how should i proceed ?

The nonpartisan Congress.org (http://www.congress.org/congressorg/power_rankings/index.tt) released rankings of the most powerful legislators in Congress this week, and just as interesting as the newly empowered were those hovering at the bottom of the list. Predictably, House Speaker Nancy Pelosi and Senate Majority Leader Harry Reid topped the list, and the list quickly moved to committee chairmen with muscle.
The rankings took into account the legislators' ability to get things done by the traditional paths of leadership positions and committee assignments but left room for the "sizzle" factor -- reserved for those who "exert or possess power that can't be measured by these standard measures." Specifically mentioned in this category were three presidential candidates, Sens. John McCain (18th), Hillary Clinton (12th) and Barack Obama (27th).
Sen. Elizabeth Dole, sadly, was not given points for sizzle -- or much else, for that matter. She ranked as the 95th most powerful senator. Yes, that is out of 100. Vying for the bottom rung was also Sen. George Voinovich, who despite serving since 1998 ranked 90th. And as if he hasn't already had a bad year (or two), Rep. William Jefferson came in dead last in the House, awarded negative "fizzle" points due to scandal. Being accused of stashing a $90,000 bribe in his freezer was bound to affect something, since it tipped neither his reelection campaign nor his ability to get a committee assignment.

When one applies for AP in Multiple entry category they will be given 2 AP dox. lets say if one has used both on travelling like both has stamp of POE can they reuse the same for future travel with in the one year period of validity ?

Some of my friends who are in their final year of a residency program on a H1b (non profit) have got job offers from profit organizations and their H1b transfer is subject to cap. Their transfer will be done only in May/June 2007 and now they are stuck because of the cap limit.
A lot of people in same situation are IV members. SOme organized effort is required to this cause.
These maybe people who could not file for their "real" jobs when cap was reached.
Must we not start an organized effort and let our law makers know about this situation.

I am an American citizen. My Chinese wife of 3 years and I will move to St. Louis and buy a home there. She is a businesswoman and must return to China several times per year to take care of a business there. She will be applying for her immigrant visa very soon.
HOW MANY DAYS PER YEAR CAN SHE LEAVE THE US PER YEAR WITHOUT PUTTING HER IMMIGRANT VISA IN JEOPARDY?
Being a US resident is more important that the job, but we would like to do both, if possible.
I apprecite ANY advice formn knowledgeable people, including non-lawyers.

I left the U.S on October 30 2009. My L.C. [Perm] had been filed on July 30 2009 and was recently approved.
My 6 year H1B expired on Feb 2 2010, with approximately 160 days available for recapture.
My company needs me to return to the US urgently and is wanting me to apply for a Business Visa.
Subsequently when I am in the U.S, they intend to file for I140 and then 7th year H1B extension plus recapture
time based on pending I140
Is this feasible? -- What impact would it have on my green card application process?

Still an agent came from USCIS last week for site inspection. He talked to HR first, then came to my room. ASked for an photo id, then asked usual questions, job responsibilities, salary, location,
educational qualifications, salary statement...
took some fotos of my room and desk b4 he left.
Everything went on for 15 mints.
Thought, I should share this info with you.

My wife couldn't get Xray on a failed TB skin test, because she was pregnant at the time we filed our 485. Our priority date will be current in August.
Should we wait for a RFE on her medicals? Or is it possible to go ahead and do it, and send an update to USCIS?

Here is my situation, my PD is March 05 and my 140 is pending for the past 3 months. Do you guys think if I get my 140 approved by Premium processing it would increase my chances of 485 approval this fiscal year? BTW, as its obvious from my PD I will be filing my 485 in July, God willing.
