Last Friday was a depressing day for me. A businessman and his daughter visited me in my office. When I asked how they had learned about our law firm, they said a lot of flattering things about how "famous" we were and about our "great" website. My company changed address while my transfer H1b petition was pending. We moved just across the street from the original location and thus the company did not call USCIS to notify them of the address change because we still had access to our old mail box. Unfortuanately my approval notice was returned back as undeliverable and I received an email to that regard.

The secretary from office called USCIS and had the address changed immediately, its already been a month but we still haven't received the approval notice at the new address...has any one else here has similar experience...how long do you think we should wait before we call the USCIS again ?

My wife is on F1 and has applied for AP.
We have been waiting forever for AP(nothing new, right?).
Since her F1 is invalidated for the purpose of re-entry, can she apply for H4? and use that for re-entry?
If you have done this change to H4 recently, I will very much appreciate your reply.

I am filing H4 extension for my wife by myself. I see following 3 quesions in the form 539. Last July I filed 485 for me and my wife. What do I have to say here (yes or No)

Has an immigrant petition ever been filed for you or for any other person included in this application?

I had filed my i-485 along wid my whole famliy on 2nd july . My checks got cashed yesterday for all of us. But when i seee online its shows case pending for all of us expect my younger son ..w ehave reciept but we cant locate his reciept number online.Its showing number doesnot exist . So wat can be the reason behind it. I have reciept numbers for his i-485 and i765 juss can see his status online..

I am in L2 visa right now and I have an EAD to work. I got a job that I need to start on oct 01.

My spouse status will change from L1 to H1B from oct 01, as his employer filled for H1B.

Our L1 & L2 are valid until Aug 2011.

I don't have H4 yet.

What are the various options available for me to work?

1. Can I use my EAD to work which is valid until aug 2011?

2. Can I apply for H1B for me? If yes when I can start working with my H1B.

3. Is there is any way to maintain my husband L1 status until it's validity(Aug 2011) and then switching to H1B after L1 expires?

Thanks to IV for making the multi year EAD/AP happen. Since USCIS might or might not announce this, I want to track when people start getting these multi year EAD/APs. Anyone in the IV community got one of these yet?

Not yet....you know they are very lazy to implement it esp. good one's that people are benefited..

I have my H1B visa with NIIT. My petition and visa for the first 3 yr period expire in October 2008. I am returning to India in April '08 to do my MBA, and will resign from NIIT, and therefore will not be able to renew my visa.

If I want to work in the US after I graduate, say in August '09, can an employer file a transfer petition based on this visa? Or Will they have to file for a new one under the quota? And if so, is there a way that I can hang on to my H1 status?

I am trying to look up dates for H1 visa stamping in Canada and the website says no appointments for 6 weeks. I am thinking of going for visa stamping in July. is there any chance that they might open up some more appointments in the next few days even though it says unavailable currently? please post your comments and experiences regarding this.

Kudos to my colleague Elissa Taub who pointed out something rather interesting that none of the supporters of the Arizona law have told Arizonans. Under federal immigration law, a removal proceeding is a civil proceeding and one is not entitled to a public defender or any assistance in paying for help from an immigration lawyer. However, the new Arizona law makes it a state crime to be illegally present in the state. Hi

I have heard in the past from a lawyer that when in H1B status the filing of Green Card must be done and labor certification approved before the 5th anniversary of H1B status. In other words, one cannot start the process for a Green Card in the 6th year of H1B status.

Is this correct? Or is the lawyer being overly cautious?

If such a rule does exist can you please point me to the exact regulation?

I dont think this means anything. With the huge influx of AP and EAD applications - I am quite certain that the last thing on USCIS's mind was making sure that the LUD was kept updated for the 485 apps. The important thing is that you have your 485 receipt and that is the acknowledgment that they have recieved the application and its in order.

Hello Attorney,

I filed AP for me and my Dependent , Unfortunately USCIS just picked the application on the top of packet ( My Application ) and i got the receipt No , I dont know what happened to my Spouces Application her check is not cashed and no receipt no , I suppose her applicaiton is was just placed with my applicaiton and was considered as just one application .

Now what are my options , can i go ahead and file one more application , i know its literally impossible for me to call uscis and Track my wife's application , can i go and file a new application for my Spouse . Please advice.

I'm sure the lawyers have already told you that this is not possible. The company cannot refile PERM now because all the ads, posting, etc are too old. They would have to start again.
