You can only stay in the US if you can change to another lawful status. As a UK citizen, the only work-authorized status that might be available, though difficult, is O-1 for extraordinary ability aliens. yes. you cannot file AoS while out of country. you can file for yourself, but will have to file for the dependent/s when they return.

Hi,

I received my EAD today, but my I-140/I-485 are pending. Is the EAD of any use right now? I think I have to wait for the I-140 to be approved before changing jobs, right?

Does anyone,please could help me with the following query?

If my I-140 is not approved yet, is Uscis touching my I-485 application....in other words is I-485 being processed (not approved, only processed)even if I-140 is not approved?( I applied concurrently in August 2007, and my priority date is current, Eb3 ROW).

Hi All,

I am purchasing tickets to INDIA in an hour. Haven't thought about this much until one of my friends asked me this. My priority date is March 2005. I am planning to travel to INDIA using AP in December last week and come back in first week of Feb 2010. IF my GC gets approved during my stay in INDIA, would it a problem while coming back or if an RFE is issued, would it be a problem.

Hello everyone,

Few weeks ago I had filed my wife's H-4 through my H1B. We have already received the receipt for her H4 filing. The H4 has not been approved or for that matter denied. She got a new job and she needs to start in few days. She intends to use the EAD that she got from our I-485 filing. She had never used her EAD before.

The questions I have is -
Do I have to do anything to notify the USCIS or let it be?
What will be implication on her H4 petition, will that be denied because she used her EAD?

Any suggestions would be greatly appreciated.

We are looking to talk to a good immigration lawyer and seek opinions on the following

(1) H1b visa transfer process for physicians after residencies into a jobs
(2) How to handle licensing issues - murthy.com has some info, but we need a better perspective
(3) Green cards for physicians - eligibility and time frame and minimum requirements etc..

Any any other pitfalls or booby traps that one has to be careful about.

A lot of physicians do visit IV website - am wondering if there are any user groups or forums on web that discuss potential issues and other stuff that we discuss on IV.

I know this issue is still a grey area and certainly no one seems to know a concrete answer to this.

If i have my H-1 Visa and EAD as well. Can i continue to Work on my H1-visa for the primary employer and take up a part-time job with the EAD.

I have hear ppl say that H1 becomes void once EAD is used. Is there any kind of document advocating this? I have not seen any. Lawyers have conflicting opinoin. Has anyone thought about this. I have decided to take an infopass appointment and ask the IO to show me a document that states that H1-becomes void or The other way around.

Can anyone shed more light in to this. Thanks

USCIS has requested that the Office of Management and Budget (OMB) approve the continued use of the current version of Form I-9. Once the extension request is approved, USCIS will update Form I-9. At that time, employers will be able to use either the Form I-9 with the new revision date or the Form I-9 with the 02/02/09 revision date.
