Hi,
My employer has filed second extension and due to the fees was not sent with the proper amount they sent back the application saying it has denied and sent an I-290B with it to apply for appeal, i just got a letter and my H1 was exp in Dec 07 please help what shall i do, i am in helpless state my employer is working but any help or info is much appreciated.

Do not worry as long as the appeal is filed and with a lawyer cover letter explaining the mistake.
The most important thing is that you are in status when you filed ... which seems so, since u r filing extension and not transfer

Unfortunately not.. AP is only for 1yr. You see in these tough times both US gov. and our attorneys need to make some extra cash..:rolleyes:

you are half right, the country quota laws were put much earlier than the off shoring companies, but remember that the retrogression only started in the last 10 years when those companies came in the picture and skewed the lines .. that's ur cause and effect!
I am in software and would be satisfied with resticting this rule to the software field, but feasibility wise, rules won't get micro-tailored this way.
I always tell myself i shouldn't go on with the discussion, but here i go again..

I had gone thru a layoff experience 3 years back.
They laid my team off in April, but for some reason said that they will keep us on payroll till July (effectively we got a paid holiday for 3 months :-) ) and gave us severance on top of that.
I took the 3 months to do job search and started the new job in July (technically there was a month gap between when I stopped being on payroll and when I started new job).
Recently when I asked old employer for employment verif letter for I140, the letter said I was employed till July of 04.
In general my feeling is, as long as you have paystubs and employment verif letters that you can use to claim you were employed till a certain date, you should be ok.
How much of a grace period on top of that USCIS gives is a hard qn to answer (just like anything else related to USCIS) ?

Accountability. Ok great, accountability is a pretty good concept. However I think the OP is targeting the wrong people here.
Do we even dare to hold the CIS/DOS accountable for their wishful manipulation of PDs? These guys can't even give us information that's there in their own systems.
Did we raise our voice when H1Bs (an arch which all of us have passed through) were being demonized by the media and politicians?
So we are not holding the people who have been the biggest beneficiaries of our money accountable, why hold a volunteer group, who are nothing more than regular people like us with families and personal issues accountable for trying to fix something that's broken.
Shoot in the city I live in, it's like the Richard Pryor paraphrase "I see brown people"
Yet when we want to discuss agenda and action items, how many show up: 6, yes, 6.
Maybe next time we'll put up a board for free pizza and beer.
And here you are giving IV lunch money and asking for bill passage. :rolleyes:

You can apply for ITIN even if your spouse is not in US. I have done it ealrier but the only condition is she shouldhave visited US on dependent visa last year for your to claim?

My wife never been to US and I am married for 2 years now. I have been filing my return as Single.
Last week I talked to IRS and they said I can apply for her ITIN without her being present in US. The condition of visiting US applied to other dependents and not for the spouse. She has to sign my tax return though that I have to mail it to her and she will mail it back to me with her signature.
Not sure how true is that and I don't know if I should give it a try or not.

Just got off the phone. The Lady said she is getting hundreds of these calls. She also said the Rep smith had not made his position public. She asked if I was part of the same group that has been calling. I said yes but I am calling on behalf of all the legal immigrants who would like to see a better streamlined process so that thousands of tax payers in US can breath a sigh.

My GC filing company is not a non profit institution still my labor took 2 months and I 140 took less than 3 months.

I was reading the posts, I somehow believe there are some variations among EB2 categories, of what we all have been calling I,II or three.
It is not not primarily based on salary only, I believe, it has more to do with the nature of your job, job title, size of the company, type of company, for profit or non-profit.
My wife is a University professor, applied for our GC, EB2 India PD date august2007. We got our labor approved in a less that 2 months, we got our I40 cleared in 5 months, ( applied in January 08 got approved in June).
I believe , we are able to move so fast in this process was mainly because the type of company she works for, in this case the non profit institution.
Now at this point in time, I would like to ask all the gurus, are the dates going to move fast in next few months?

Update: In the subcommittee hearing tomorrow let us expect our issues raised. IV has successfully communicated issues of IV community to the subcommittee members. Let us wait to see if all of those are addressed in questions. This is all possible due to support of members who contribute to help us with lobbying efforts.

Guys, You can talk to your senators to help you in this situation. You need to sign a privacy release form and provide a letter explaining what happended. I heard from my freind that it worked before. So you can write to your senator about the situation and ask for help. I really don't know if it is goign to make a difference but i thought it is worth a try since we filed the application legally.

My employer started laying off people an year ago and there were too many cycles so far. I was immune to all those layoffs until Friday. They eliminated everybody in my team, 15 people in total.
I am in the final stage of my GC and I have 2 year EAD. My H1 is expiring in March and my (ex) employer already paid my Attorney for the 3 year extension. They have decided to extend my H1 and paid for the expenses. But in the mean time, they were forced by the investors to show profitability and hence the layoffs.
My (ex) employer is based in Massachusetts and my Labor Certification was done from this location.
I have received job offers from some of my employer�s clients. However, they are based in other States (CO, OH & WA for instance) and they might not be able to do my H1. One of them is interested in hiring me on a contract basis, since they had frozen new hiring.
Is taking a job outside of Massachusetts impact my pending I-485? or Will it violate my Labor Certification conditions? I couldn�t find an answer for this anywhere.
Also, can I take contract jobs for the time being?
I sent out an email to my Attorney with all these questions. But, he is not available until Tuesday next week.
