I finally received my I485 denial notice. I had to make 4 infopass appointments to get the letter. My attorney hasn't yet got it. I will be filing for MTR and sending the request to Ombudsman per another thread on this forum.
Was curious if others have the following in their denial notice:
last paragraph:"There is no appeal for this decision" This decision is without any prejudice to any future I485 application that you may file....blah blah.."
They have quotedsection 245 immigration and nationality act [8 USC 12s5]..states " underlying visa petition upon which seek permanant residence has been revoked...blah blah"
Is this pretty standard?

Red Comment No. 1: Learn to reply back with a cool head. Real, focused, communication in IV should be a marketing strategy for geting more donors...if that is not there...enjoy !
Neither am I IV's customer service, nor is IV core. All this guy needed to do was to search the forums and read through that thread that I pointed him to, and voila, he would have know what is IV's intention on the donor forum. He probably knew about it but just decided to throw some oil to the fire in this current thread. I agree with your reasoning on giving more focused replies but then that's what I'd keep doing all day because there are tons of folks roaming around here who have nothing better to do but criticize IV!

I am really pained to read anands post.I admit that everybody has a right to speak, it doesnt mean that one has to demoralize and demean ones efforts and so many other like minded IV members.
I came to know of this site last december untill I met one of the admnstrator who had come down here for a conference.Since then I have advocated this site to so many people and in my company its a Fortune 500 company we have lot of diverse memberships like Indian ,Chinese and various other countries memberships in our company.In our indian club we have about 100 employees of indian working for this company.Apart from circulating the site I have made it a policy of calling up people on phone every weekend and telling them about this site and work lying in front of us to get it done this year.
Do you think that I am helping this site or the IV core.NO I am helping myself.So please be consructive and help the cause and help yourself.
If you are not really convinced about the direction of the efforts of the members of this site.You are entitled to walk out.Its a free country.But before you post any message give it a thought and think about the cause rather than people or IV core.

I never said I agreed with country base quotas for EB. However; lawmakers, etc. are not stupid people. We have to try to understand why they are there and why it is not being changed. We have to understand the symptoms before you can find the cure.
Your argument is that the country quotas help limit nepotism and discrimination based on national origin. However, this is already prohibited under DOL rules if you look at form ETA-750A. Therefore, if this is happening, it means there is a failure in the labor certification system to prevent this type of discrimination. Also, nepotism is not all bad as the Clintons and Bushes have been demonstrating :D.
The country quota owes its origin and sustenance to deep national insecurities around race. It will change eventually as the makeup of the nation changes over time. In the short term we will see movement as the UK bumps up against the 7% limit.

Nope I didn't mention anything about being the proud donor etc. in my first post. You are the one who wrote the comment to my post in the most indecent and disrespectful way, bringing the point of donor. The total number of applicants from other countries can be derived from roughly estimating number if H1 holders, adjusting for Indians and Chinese, and then dividing by 2 (50% of H1Bs never end up getting a green card), and then multiplying by 2 to adjust for derivatives. The bottom line - there are visas available in EB2 ROW and EB1 categories (which are current, meaning, undersubscribed), that are getting redistributed to EB3 ROW. This is why EB3 in total is using more than its share of 140,000 EBs. In fact, I believe the dates will be moving pretty fast on EB3 ROW, it will probably get all current in a couple of years.

I do not see anywhere in the legislation where it says that EB1 is "more skilled and valuable" that EB2 and so on. What it does say is that the various categories require a certain amount of education and hence my point! I am not insecure but I AM frustrated at your arrogance. Look before you leap and read the Immigration Act!!!!

Guys, temper your expectations. Cust Service Rep at USCIS are not trained to answer the questions that pertain to things like visa bulletin's effective date and whether or not they will accept the ones or reject the ones on July 2.
Cust Service Rep is for general information for those who cant or wont use the USCIS website and other sources of information on the internet. Or for those who dont speak English.
Cust Service is not intended to provide complex answers. Last I heard, even the Vermont service center folks didnt know about bulletin revision and they were turning down 3-year extension requests for H1 visas thinking that the bulletin is current until confronted by lawyers who said that bulletin is unavailable and now there is reason to give out 3 year extensions instead of 1 year extensions.
If Vermont service center was unaware of visa bulletin revision, then what do you expect from a Cust Service Rep who is trained to answer questions that cover information that can be fit in 20 pages ??????

We moved to Florida from California last week. Did AR-11 yesterday. We are about to file AP, our I-485 is pending at NSC but Florida comes under TSC.
So not sure where to send our application.
Intending to send following supporting documents.
1. 2 PP Size photos
2. EAD copy as we switched from H1B to EAD
3. I-485 receipts.
Should we include any additional docs like Copy of your previously issued AP or passport copy (1st ,2nd page and last 2 pages) or Last expired I-94 copy.
Any advise would be of great help.

That's why its called team work.Every individual team member contributes with their specalized skills and thats what they were hired for in first place.
Its just a matter that the Company felt that your skills require only a bachelor's degree for the work that you perform,whereas other company felt it requires a master's degree.
Also as a matter of fact since the last 10 years the technology has changed in such a fast pace,I can confidently say that just because someone is an architect in J2EE does not mean he is better than a Mainframe Programmer. Its just means that someone were at the right place at the right time during the Dot com boom.
Its easy for people working at big companies to move around and work for different projects as the size is directly proportional to the number of clients the company serves. Whereas for a small firm,due to their nature of business model,its always serving the Big Fish and supporting their projects. You can find number of sub-contractors working for IBM,HP etc etc. So if an employee of Big company and a contractor working on the same project does the same work,how are you as an employee better skilled than a contractor?
Its just that you chose a comfort zone by abiding by your comapnies policies,whereas a contractor chose to move around and work on exciting projects that suits his/her challenges.
So bottomline,someone being in EB2 or EB3 is just by choice of the individual and circumstances and here I assume each of them have same experience and qualification.
Example someone having an Engg degree from IIT is no different than a person from an average engg working on the same project. Its the IIT graduate that chose to work on the project that and average engg qualification person chose to work.

I dont know the whole background...but they say they will use 5000 unused visas per year. Where do these unused visas come from? FB visas?
I'm guessing if its contractors/workers, its likely to come out of EB category. This is bad news! They should have additional numbers for these situations rather than taking from existing pool which is already retrogressed.:mad:

this whole issue of undistributed visas has been going on since 2005. It was thoroughly digested/analyzed by many, many people. The discussions had a lot of infighting just like this thread does.
The law hasn't changed; therefore, a different interpretation leaves open possibility of lawsuits.
I read the law to say specifically that if there is more people in que for greencard then hard limit of 7% to anyone country. Until there is less demand for eb1/eb2/eb3 as a whole then hard cap.

Last year; particularly the summer, visas were used to overflow to china/india when they shouldn't have because in september eb3 row was retrogressed and so was eb2 row. Under the law; if eb3 row is not current then there can be no overflow of visas.
Most of row has sat idly while the visas have overflowed when they should not have. All it takes is someone from ROW to sue USCIS over this. However; no one does simply because by the time the lawsuit comes; there dates would probably be current and lawsuit would go away.
