Employer 2
MAR-2005 to MAR-2008
Employer X
JUL2006 to JUL-2009
Applied 485 in JUL-2007
Applied EAD in JUL-2007 along with 485. Valid from 09-2007 to 09-2008
Applied another EAD in 2008 before 1st EAD expires, which is good until 2010
thank you.
Great!
With this info, your attorney can easily demonstrate that you were authorized to work for "Employer 2" at all times since last entry in the USA until date of filing for I-485.
There is nothing to worry about, IMHO.
Good Luck.

I like Singapore Airlines. They are good and on time, when ever I traveled with them from west coast. I never traveled with AI and don't think I will go with them in the future. I would rather try Jet Airways as I heard good things about them.

Since you have not joined company B then why you worry whether they cancel H1b or not. As long as company A is having your H1b, nothing to worry & no need for reapplying for H1b transfer back to company A. There is no concept of H1b transfer, every company apply a new H1b when you join them and employer/employee relationship exist as long as they don't cancel H1b. Hope this helps.
My friend has a similar situation.
He transferred H1 to Company B and worked for 5 weeks and descided to come back to company A (He is 100% sure that Company A didn't revoke / calcel his H1 and he has valid H1 till 2009).
IS this OK?
Please help by clarifying...
Thanks

Most countries do not have 9,800 EB applicants every year - in fact, most countries use well under 1,000.
The total number of applicants from other countries can be derived from roughly estimating number if H1 holders, adjusting for Indians and Chinese, and then dividing by 2 (50% of H1Bs never end up getting a green card), and then multiplying by 2 to adjust for derivatives. The bottom line - there are visas available in EB2 ROW and EB1 categories (which are current, meaning, undersubscribed), that are getting redistributed to EB3 ROW. This is why EB3 in total is using more than its share of 140,000 EBs. In fact, I believe the dates will be moving pretty fast on EB3 ROW, it will probably get all current in a couple of years.
Yes. The overflow will go to EB3 ROW first and then to the over subscribed countries and will get evoporate :) The avaiable visa's then goes back to square one. This is why at times EB3 ROW is also getting back logged and many in ROW oppose this trend as well.
I am of the opinion that there should not be any country specific quota in EB at all. When it is already proved that no American is available for the skill set required and being substituted with a Foreign worker, then from where the nationality came in to the picture? Does the companies bother about the skill set required or the nationality? If not, then why USCIS should bother about it and create a mess in the work force? I hope they will realize this soon and make amendments accordingly.
Thanks

What I meant to say, youll succeed if you have the capability (with your professional knowledge, experience and skills) in your professional filed but definitely not with USCIS.
I can say, USCIS is a great leveler in this aspect. Everybody from PhD to Programmer is same in front of USCIS. All have to wait 10+ yrs with mental tension and anxiety, no matter what your caliber is and how successful you are in your profession.
Dont get me wrong here. I also had to suffer for visa stamping, renewals, I-94 issues, PA etc in US Visa processing (nothing sever though). At the 5th yr of H1-B, I just decided.. to hell with that.....
I don't know about you guys, but, I would be heart patient with that kind of anxiety in another 5 yrs of GC process . Really need a lion's heart to pursue US GC now days
I agree, India is a far better option.
Assuming this discussion is about immigration/permanent-settlement and not about short term visits, work and study.
On the side note, The only problem faced in india is over population which triggers almost all other issues. If india implements onechildpolicy most of the problems faced today will disappear in few decades. Your child (note: singular) need not leave india to enjoy international level lifestyle & benefits.
As a backup plan to greencard advocacy we need to lobby the indian government to implement onechildpoilcy immediately.
ya sure n make lalu yadav the minister and ambassador for the same....

I still like the idea of the "Gandhi" character. 10 IV members could dress like Gandhi, practice some coordinate steps and go for a parate on July 4th. That would be a pacific way to demonstrate our frustration.
We just need to find 10 skinny, bald and friendly Indian male members. I am afraid that based on how this process has depressed our community, there are a number of us with the two former qualitities required.
I don't think you should solicit members on the forum without fully letting us know the overall tone and message of your film. Where will the film be distributed and how it will be used? Who is funding your film? Get in touch with Immigration voice organization so that they can help you and let the forum members know if we should help you and if you will convey the right message for us through your film.

All I heard is something like below. I am not sure what I heard is correct.
1. Bes tway to take 401K out is to rollover the 401K into Roth IRA and then withdraw from the account after 5 years. You can save lot on taxes.
2. For all H1b holders, there is a form which you can fill and submit to IRS which says you want to get all the SSN money back. But once you fill out this form and get the money back, you SHOULD NEVER enter US for any reason. I do not know what the form is.

Republicans chose VP just to give them the edge. It doesn't matter to them if the VP-nominee is qualified or not or can be President in a heartbeat or not.
Selection of Cheney as VP lead to the outpour of financial support from oil and construction industries. More money, more power, more ads. They are playing dirty politics. So dirty.
Obama atleast has fundamental values that makes him a leader. Young as he is, inexperienced as he is, means he is not polluted by this dirty politics.
I'm really, really scared for all of us immigrants if McCain wins this election. When a Republican president is under control of the elites, that creates terror from within.
Maybe in the future when he is president, an i-485 denial notice for a person with no underlying status will be delivered personally by ICE officer, put a handcuff on the person, and straight to detention until the next flight back home. That will be the situation if we get a President under the control of few elites, extreme anti-immigrant, powerful Republicans.
McCain already backed-out from his CIR stance. He said categorically that if the same CIR, which he co-sponsored and voted YES, is put on vote today, he will vote "NO".
I got 2 red dots for speaking my mind above. Here are the comments given by those giving red dots to me:
Do not screw up your GC by posting such comments.. delete them if you will to be safe. Admin
Your comments may screw your GC Chances. .delete them admin
First of all, who is "admin"? Is he the administrator of this forum or just someone disguising as admin?
Secondly, if these comments were true, are USCIS reading our posts and can deny my GC application due to my political beliefs and opinions?
Thirdly, if USCIS IO call "IV Admin" and ask for my IP address, will the "IV admin" give it even without my knowledge and even without court order?
Lastly, I apply for a GC in the US because I know I can freely express my mind and opinion. US is not a communist country. If because of what I said here, US will not grant me a GC, then I will fight for my rights.

the world is not fair, I am willing to fight my part to make it fair and just for all.
Kartik, as long as we, the EB3 do not come forward and collect huge amount for lobbying, we will continue to lurk here for many more years.
Unfortunately the sad part is, whatever lobbying is done actually helped only EB2 I, may be due to a wrong notion by USCIS that all Hi-tech immigrants are EB2. This could be a fact as there are thousands of 245 cases that fell into EB3.
Another bad thing was that USCIS release this VB yesterday which means one extra day to CRY.
I do not blame any one, but ourselves. We do not want to spend money and hence dying in this process. No solution, but cry at every VB day.

Ok. Visa bulletin for December gets published. We are all shocked or surprised by the cut off dates. So, we decide to bash USCIS, run all possible permutations on visa numbers (how many different ways are we going to continue analyzing 140,000 visas), some have even proposed fasting and there are some who are threatening to move to Canada or India (I am not sure who is stopping them).
Let us analyze all the proposed solutions and see if they will really get us anywhere:
1. Bash USCIS: I am not sure if anyone at USCIS or the administration would care. You can stand at the top of Washington Monument and scream and not a single soul will care.
2. Analysis/Paralysis of available visa numbers and the possible movements: USCIS, the department that has access to all the required data is struggling to forecast visa availability, but, I see my friends here with very limited access to data trying to forecast Visa movement. I can bet, even with all the smart PHDs here that we will not be able to forecast visa availability even, if we built the most complex model and continue to have limited access to data. So, this is just an exercise in futility.
3. Fasting in front of Governors office: Great idea! We can work off all the excess weight that we may have put on that we have gained due to over eating (one of the symptoms of stress or depression). I think we are choosing the wrong time of the year to do this. It is cold outside and I am not sure if anyone would even stop by the poor souls to pour us a hot cup of coffee. However, we may gain some publicity. Better than idea 1 and 2.
4. Moving to Canada or India: Please do and USCIS will be glad that they have one less case file to deal with and Numbers USA or Lou Dobbs will pay for the ticket.
Unless we stop these frivolous discussions over pathetic suggestions to fix the problem we will continue ignoring real solutions.
We need to think and execute with a sound long term strategy (12-18 months). Let us not try to eat the elephant in one bite. Let us fix this problem with small, manageable and doable steps.
I hope I do not offend anyone. I think it is time to be serious about the road we take from here.

You should be EB10 and not EB2! Some folks in this forum are really crazy!
There is no relationship between approval/duration of EAD and movement of PDs.
By the way, since India won all the previous encounters with Pak in world cups, India will win on Wednesday!
Most EB2's who are talking on this forum are idiotic, egostic and too much of themselves to think straight. Case in point Smugbee, SNathan and TonyHK. Since they don't have ead they want ead and thats all they care about. As long as they get to file 485 and get ead they dont care.
When an eb3 complains about waiting for GC he/she is a whiner and has to recognize the superiority of an EB2 getting GC before EB3 even if teh EB2 is 1 year in thsi country and EB3 has been waiting for 12 years.
When an eb2 complains about not having ead his concerns are valid and nothing else is more important on IV thean that
Absolutely right! Now line up the reds.. Oh, maybe you finished your quotas today, so let's wait till tomorrow

Well Said ! I guess lot of us are looking for the slightest possiblity of the applicaiton going through instead of getting rejected..
Anyways, Any guesses on what the PD will be in Oct VB? My guess is they'll not progress much and will try to stick to the June Bulletine timeframe..
What a bunch of morins we are. We are calling USCIS to find out if they are going to accept our applications that were sent on Jul 2nd 7 55 am and Jul 2nd 9 01 am will be accepted. Lord have some mercy on us and give us some brains to read the USCIS update. Damn it. The morons who answer the phone lines do not know jack about W T F is going on. Thats why you were being put on hold. Stop calling USCIS crazily.
