is UNLIKELY to pass at least in its current form. Public hospitals, underserved area clinics, Universities are not Google and Oracle!!! They'll go under if they have to pay 5000 $ for H1Bs. People probably don't have the faintest idea under what kind of financial strain these are. There will be exemptions for universities and non-profit organizations.

The visa restrictions, Cap and rules for H1 and H4 all were framed to protect American jobs. If H4 is given work permit then there is a fear that one more job may be taken from the American people. I am not telling it is correct but everyone are in that situation. Also we cannot resolve all the issues. L2 can work H4 cannot work is discrepancy. But one person working in a home will not have any stress especially when there is kid. We have to consider this is an advantage

I agree... i dont think its wise to call USCIS about the VB fiasco... the operators are probably minimum wage paid and are reading off of a book/compter screen.. not the ppl who can make decisions.. if it werent the us govt, we would have calling up even lower paid workers in India/Philipines and hearing from them... instead of calling USCIS, please spread the word, create awareness in the political system, press and media..

Guys, let me say something here.
$5000 for one query is not an unfair amount of money. The reason I say this is because I know a thing or two about writing quality queries, I have done that for the last 6 years of my 9 year career querying the heck out of Oracle CRM.
It does take time to write queries and the time it takes depends on how many pieces of information you want to bring together. The wider your spreadsheet is for the final output, the more islands of data need to be connected to fetch that output. Those who are familiar with SQL would know that I am talking about going thru potentially 20-25 tables and joining them to get data. This is probably not going to be a select * from 485_cases kind of query. If it takes 100 hours of time to write such a query, at $50 per hour of programming time, it could be 5000. Most likely it may be fewer hours if they have a programmer with knowledge on staff.
The problem here is not 5000 dollars. The problem here is that the situation is hopeless because they dont assign country of chargeability to pending 485 cases up until they are ready to approve them, if I read it correctly. The data that is not captured is the data that cannot be queried, simple as that.
And on that note, thanks to "Needhelp!" for shining some light on USCIS process thru her FOIA.

Yes immigration reform was on many of their lips....all we can do is hope they consider it sooner rather than later...but who on earth trusts politicians. I am still thinking that the embittered Democrats will try to strike hard blows to pave way for a Democratic President in 2008...that is going to be there main agenda - by repealing tax cuts, calling committees on War, etc to take the Pres to task....They have called that out too many times...for us to ignore that it will be their # 1 priority.

I thought only who have advanced degree from US universities in STEM with 3 yrs exp are exempt from quota. That's what the talk all over the media. I am not sure how this is going to be, because 3 years of US experience is not very hard criteria to meet for which some of the votings won't go well. But have to wait and see.
Here is what the amendment specifically says and this exempts all US Masters/Ph.Ds and foreign masters/Ph.D in STEM with 3 years experience.

``(A) IN GENERAL.--The worldwide level of merit-based employer-sponsored immigrants under this paragraph for a fiscal year is equal to--
``(i) 140,000, plus
``(ii) the number computed under subparagraph (B).
``(B) ADDITIONAL NUMBER.--
``(i) FISCAL YEAR 2007.--The number computed under this subparagraph for fiscal year 2007 is zero.
``(ii) FISCAL YEAR 2008.--The number computed under this subparagraph for fiscal year 2008 is the difference (if any) between the worldwide level established under subparagraph (A) for the previous fiscal year and the number of visas issued under section 203(b)(2) during that fiscal year.''.
In section 501, insert after subsection (b) the following:
(c) Providing Exemptions From Merit-Based Levels for Very Highly Skilled Immigrants.--Section 201(b)(1) of the Immigration and Nationality Act (as amended by section 503(a)) (8 U.S.C. 1151(b)(1)) is further amended by inserting after subparagraph (G) the following:
``(H) Aliens who have earned a master's or higher degree from a United States institution of higher education, as such term is defined in section 101(a) of the Higher Education Act of 1965 (20 U.S.C. 1001(a)).
``(I) Aliens who have earned a master's degree or higher degree in science, technology, engineering, or mathematics and have been working in a related field in the United States in a nonimmigrant status during the 3-year period preceding their application for an immigrant visa under section 203(b).
``(J) Aliens who--
``(i) have extraordinary ability in the sciences, arts, education, business, or athletics which has been demonstrated by sustained national or international acclaim and whose achievements have been recognized in the field through extensive documentation; and
``(ii) seek to enter the United States to continue work in the area of extraordinary ability.

:D you talk as if the president has the power to do any and everything. If that was so then CIR would have certainly passed last year, it was GWB's pet project.
(IMO, mcain is honest man and a well tested politican, dont want to comment about obama. dont want to get into the discussion about who is better. I wanted to comment about the power of a VP when she becomes a president if and when the president dies. people talk about the VP being a heartbeat away from the president but nothing about having an inexperienced and untested president...anyways...)
if Obama wins:
+ its better for the world in general. The last thing we want is more of GWB policies destroying both America's economy, civil rights, and respect in the world.

- FB immigration will be put in preference over EB, we are screwed.

Do you want someone that stupid, who already abused whatever little powers a mayor and governor has, to be the commander-in-chief of the united states armed forces?
Either way immigration-wise we are screwed. I think for the sake of the rest of the world we must wish that this time McCain loses this election. He has made a very stupid VP choice.

I heard from my lawyer today that my LC was finally cleared. When I heard the news, on one hand I felt a sigh of relief, but on another hand I was still feeling angry. It took almost 5 years to get the clearance in spite of being a simple straightforward case. I was simply exhausted with the long wait time and there was simply no energy left to celebrate. Though my LC has cleared, I still would like to join the fight against this injustice. If there is any effort on anyone�s part to address this injustice, I would like to support in any way I can.

Yes , its Free :D Anyway - lets talk with a 3rd person (maybe USCIS) and confirm. Its Free, if you read the EAD forms its clearly written that once some one pays $340 ( not other amount) it becomes FREE for ever. I just checked the EAD forms again before writing this post - let me PASTE from EAD forms if that clear the confusion.
Renewal EAD: If this is a renewal application and you

1. (a)(8) Citizen of Micronesia, Marshall Islands, or Palau;
3. (a)(11) Deferred Enforced Departure; or
