I spoke to a woman in the USCIS customer service and she doesnt know Jack. All she told was there wont be any further authorizations starting from June 02(as idf we dont know this. Teh whole world knows). They will put all the applicatiosn received on July 02 in hold and may start processing from Oc 01 2007. As i said earlier she knows jack about the probelm. If you ask more questions they simply say that they are only customer service and this is what they know. I asked who else should i contact to get more info and she told i have to contact them only. What an idiotic organization.

The Point system that this bill refers to is a BS , look at even canadian system they differ upto some extent on these. But the key point is this bills retroactiveness , it simply puts all those ppl stuck in BEC out of scope , the point system is not tried too , just becoz the managers of these senators thought this is good by getting a hybrid point system of Canada, Australia and UK is good enough ? This point system is worse than current sytem no matter what ever it might be good for some but logically , technically its flawed

As so many members have posted there is no such thing as H1 transfer. If OP continued to work for employer# 2 without joining employer X that is fine as long as OP's employer 2 did not revoke the H1 petition. So OP should be fine , all he has to do is point that he did not accept employer X offer and decided to continue with current employer (i.e. #2) and his work with employer 2 was authorized based on the continued validity of h1 petition of employer 2. Now I saw that OP mentioned somewhere that he used EAD when his H1 with employer 2 expired. This could be a potential reason for the RFE. Here's my take on it:
When OP's H1 ultimately expired there were two possible work authorizations which OP could have used : Join the employer X on H1 since that employer did not revoke the h1 petition even though he did not join them OR used EAD with either employer 2 or employer X. The OP got this RFE for I-485. If you are doing AOS from H1 the burden is on you to prove that even while your I-485 is pending you have not engaged in unauthorized work. I just feel that the IO is doing an extensive scrutiny of the OP's application and trying to make sure that OP did not engage in unauthorized work at point.
In any case the OP should get a good lawyer.

I think for first meeting 10-12 are enough. Let us meet and decide upon the strategy to have more people. I would prefer not to have lot of people in the first meeting.
Never say that. We need everyone. This discourages those who are on the fence.
I am saying this by experience - being a non profit and no obligation group - many people who want to do something - are just sitting on the fence finding it tough to decide whether to make the jump or not - a very good example is the rally. Most people just wanted to see how the response is and then jump in.
Every member in IV is a very crucial member - everyone has skills that he/she can contribute so just get as many people as possible - keep them intact - this is very essential. If people start backing out - others will lose morale. And slowly people will stop showing interest and when something drastic happens everyone will start blaming IV for not doing its job and will ask IV for doing fast actions.
We worked extremely hard to build the Tri State team so did California folks and other folks are catching up - it involves a lot of hard work and you will be constantly attacked by people for no fault of yours, but it is very essential that you keep up the tempo and morale - patience and perseverence is the key here for building the team. Aggression and passion must be combined to lead something.
At Tri State we recongize everyone. Everyone in this area have worked extremely hard with a lot of dedication and commitment - words will not be enough to describe their commitment. A lot of people say - Tri State was a let down for the rally - but in reality - as we have seen 1500+ members, a lot of people drove over in the last minute from Tri State Area.
It takes a lot to build a team. So get as many people as possible involved.
Come on my dear Michigan folks - Ford and Chrysler must give us atleast 10,000 members. Please wake up from your slumber. People sitting on the fence must jump right now. yes, this is the time - just join us. Help IV to help yourselves

I don't think uscis can do that. They can either accept applications or reject them. If they hold the applications for next 3 months, they would violate their long-term procedures and would fear a lawsuit because of that. They know that they are original documents in those applications that can be used once again...god knows when...
Based on the recent policies of USCIS , the revised July2nd VB and rejecting all application for Others worker in JUNE while the VB was still CURRENT for some,we cannot hold them accountable for anything any more.

Are we/employees really supposed to know all the steps involved in the approval of GC process (Perm, 140/EAD/485 etc.)?
I work for one of the fortune 100 companies, to my surprise, none of my European colleagues is aware of all the GC process. All they do is just provide documents what ever the HR department asks for. They dont pay from their pocket for GC (ideally correct). None of them has clue about priority date etc.they get communicated by the HR department about their GC process.
So putting your case in perspective. I am assuming that the HR department would just hand over the GC to the employee. Neither the HR (I think) nor the employee (definitely) would worry about the PD being current.
Ideally if a law firm is point of contact for a petition, what would they do? Would they go back to USCIS and tell them that the GC is approved by mistake? I dont think so but some one can confirm if they had experience otherwise.
I completely agree with what you are saying. We are overly-active community due to monster called 'retrogression', otherwise none of us would be knowing immigration details as much as we do now.

It is better you do it online and mention that you have pending 485 in NSC. I don't think Fl has anything to do with your place of sending.
Once you file online you can get a print out of it for your reference after you pay and USCIS will send you a receipt notice stating that they received your AP request. If they need any further evidence they would send a letter to do the same. Till then just sit back and check online.
I filed mine online and they sent me a notice saying that they would require my latest passport size photo, which I sent two weeks back and now I can see that it is in process when I check online.

Agree completely !!!
Otherwise, It should be allowed to have PD based on my First Port of entry date ?
I still say that they should be allowed to port but should go back in line.
Thanks

Thank you for sharing this info.
I filed my I140 on July 17, and it was delivered on July 18.
Would this be included in that group you mentioned that will be given receipt numbers by August 1?
Thanks...

Now comes the sequence of numbers to press
1,2,1,2,6,4
Dont think, JUST press this sequence and you will be connected to a Customer Service REP.

Overall - $5000.
Advance - $2500 within 30 days to start the work.
Is the overall work something like 100K that they have divided by the number of requests to yield 5K per request? Unlikely. I think they just sent standard 5K demand to each FOIA request to shut it down.
Even if they pay me $2500 for pulling out this info. Just 5 mins job to run the query and imagine if they get 10 requests per day. Man I wud be a millionaire within no time.
Atleast they acknowledged that it requires highly skilled individual(from their perspective) to do the job.

I posted a reply long ago - it was quite hard-hitting on Berry. It somehow hasn't shown up until now - wonder if the editors "balance" the pro- and anti- immigrant letters
BTW this Berry guy seems to be in the know of everything happening on this site. I hope at least now those blowhards among us who insist of by-the-minute updates and "where is my 20$" questions appreciate why the core members don't give updates on these forums. If you are so keen on updates, get off your backsides and pick up that darn phone !!!
