I work for a big company. Each time when I move to a new project, my company ask me to file an LCA and H-1B amendment for new project location. It takes several month to get approval until then you have wait and face all travel restrictions.
I know that several smaller companies don�t file such amendments
Does anyone who why do we have to file such amendment?
What happens if we don�t file this?

I am trying to analyse the impact based on 245i. Based on it
PIC countries benefited from unused visas a lot till now to have their PD current/move up. So based on that benefit, Also one thing is clear the unused visas if available are country indepedent and are used at the rate of 27% per quarter.
so for example 100K visas are available (which i would enjoy having )27K per quarter is available from the start of the year . Now among this 27K how is the distribution, can it be distributed whichever applicant needs PD IRRESPECTIVE of EB1,EB2,EB3(skilled, professional) Vs EB3 other or does it split by the calculations of EB1, EB2, EB3 with 28% EACH and EB3 other NOT above 10K limit

Hi,
I am working on L1 from Company A.
I have applied for L1 to H1 status for year 2008 from comany B. H1 got approved without COS. As COS not done, I continued working on L1 with company A. Now my L1 is getting expired on Aug 2010 and my L1 company want to extend L1.
While applying for my L1 extention, my H1 applival cause any problem.

My current H1 expired on 7/9, I applied h1 extension (with approved I140) on 6/30/10 with client letter (with no end date) and other documents. I got approval last week, they approved my petition from 11/18/2010 - 11/17/2011. 10th year extension.
1. What is my status between 7/10/10 - 11/17/2010?.
2. Do i need to inform USCIS?
3. I expected 3 years, but I got only one year.

I signed an employment agreement stating that if I had to leave my employer before getting my Green Card that I will be liable for all the fees pertaining to the Green Card application which my employer has been paying for while I am been employed by him.
I have heard that an employer cannot hold Green Card fees over an employee. I also believe if anything, the fees owing should drop according to the length of time that the employee has worked for that employer.
I have been with my current employer for 4 years now and I wish to leave him but I do not want to pay him for the Green Card fees as I believe that should be a business expense to him.
I would just like to know what are my rights in the above case

I have been searching in the inernet for quite some time and looks like
the following questions are still not answered properly. So any of you here who actually used the AC21 in the past can answer the below questions and it will help lot of people on this board.
1) When the employee don't have I-140 receipt number and I-140 approval copy , is it okay to use AC21 after 180 days ?
2) Do we need to have I-140 approval copy for the EAD renewal ?

Hi,
I'm presently in J-2 visa and my husband is having J-1 visa.
We both are Indian Nationals. My husband applied for J-1 visa when he was in Germany.
It is mentioned in my husband's Visa clearly that "Two Year rule does NOT apply".
3 months later, I applied for J-2 from India with his visa documents.
In my visa also, it is mentioned that "Bearer is NOT subject to section 212(E). Two Year rule does NOT apply".
Now, we both want to apply for H-1B visa seperately. I want to know whether do we need to apply for H-1B waiver?
It is very much confusing since we are Indian nationals, the two year rule applies. But at the same time, as he was in in Germany while applying, it does not apply as mentioned in the visa.
Please clarify. Thanks in advance.

You can shift to new employer and start the GC process again. The approved I-140 is useful to retain the PD if not revoked. Otherwise no use.

I filed paper based AP at Nebraska service center and got AP in 5 weeks. Pretty painless except paying them 300 for 2 pieces of paper is outrageous.

I and my wife are on h1. I want to come on her h4. She recently applied for h1 extension as her employer is nonprofit org and has some policies of his own, he files every year. She filled in may�09 and got receipt number, as the case is still pending who we can apply for h4 now. Is there any way around to apply for my h4 while the case is still pending?

You should not be getting paid less than the prevailing wage, that's the important number. A $25,000 reduction is a lot, and suggests that the job has changed. If that's the case, the employer should have filed a new LCA and amended the H-1B.
